ICASA issues new draft spectrum regulations

The Independent Communications Authority of South Africa (ICASA) has published revised Draft Radio Frequency Spectrum Regulations for public and industry comments.

The regulations, initially published in 2011, aim to establish the framework through which the authority can allocate and assign radio frequency spectrum under the South African National Radio Frequency Plan.

In addition, says ICASA, the regulations seek to establish transparent, fair and efficient procedures and processes for radio frequency spectrum licence applications.

The publication of the revised regulations follows last year's review of the current regime to determine its effectiveness.

"It was found that there are numerous numbering inconsistencies, no provisions to outline the consequence for failure to renew a Radio Frequency Spectrum Licence and the process the authority will initiate in dealing with illegal users of the radio frequency spectrum; as well as no provisions to safeguard the rights of end-users prior to a licensee ceasing to provide services that require usage of the Radio Frequency Spectrum," says ICASA.

ICASA says its new regulations seek to address these anomalies and findings.

Comments are open until 13 February.
