ITWeb terms and conditions

These are the terms and conditions for use of ITWeb’s content and services. “ITWeb services” includes but is not limited to our websites, e-mail newsletters, mobile device apps, RSS feeds, research reports, printed magazines, and presentations at events. “ITWeb content” means any content or service offered through ITWeb services.

If you use any ITWeb content or service, you agree to be bound by these terms and conditions and other policies as described herein.

ITWeb reserves the right to deny access, terminate registered ITWeb accounts or take legal action for violation of these terms and conditions.


Personal data and registered accounts

Any personal data collected by ITWeb is governed by the Protection of Personal Information Act 2013 (POPI), the Promotion of Access to Information Act 2000 (PAIA) and ITWeb’s privacy policy. You remain responsible for maintaining the confidentiality of your password or other account details.

You may not share your credentials with other people.

ITWeb may terminate a registered account at any time. If we do, we will contact you at the email address you have provided during registration.

Registered user are entitled to remove their profile, or to disable certain aspects.


Abuse

You may not use ITWeb services to conduct spam, other unsolicited commercial activities, or any other illegal activity.

ITWeb is a South African company - any illegal activity will be dealt with according to South African law.

Please notify us immediately if you are aware of any abuse of our services, at admin@itweb.co.za


Third parties and user content

ITWeb houses content, including advertising material, provided by third party commercial partners such as advertisers and virtual press offices (VPOs). Said third party is responsible for this content: ITWeb accepts no responsibility or liability for this content.

ITWeb encourages user participation such as commenting on articles. Comments are subject to our comment policy which governs hate speech and other offences.


Copyright and reuse

ITWeb content is subject to copyright and may not be reproduced in any form without written approval of the publisher, subject to the provisions of fair use. We request that when quoting from ITWeb content, you include a clear attribution to ITWeb and a link to the original material.

Third-party content published on ITWeb may be subject to copyright held by the third party. Those rights are not affected by these terms and conditions.

You agree not to use ITWeb services to publish material to which you do not hold the necessary copyright, or which you are otherwise prohibited from disseminating.

ITWeb publishes press releases on behalf of its clients. These press releases are clearly identified by the phrase “Press release issue by…”. You may republish press releases from ITWeb in full or in part, provided you prominently attribute ITWeb as the original publisher, with a link to the original ITWeb page.

ITWeb retains copyright over any ITWeb content republished in this manner. If you reproduce a press release under these terms, you are requested to notify ITWeb at admin@itweb.co.za, so that we can notify you of any changes to the content. If the material is removed from ITWeb, you are required to delete the content from your electronic storage facilities and libraries, including the Web and mobile application sites and offline storage facilities.

Liability and risk

You agree that your use of ITWeb services is at your sole risk. ITWeb content and services are provided "as is" without warranty of any kind.

Except for specific requirements by law, ITWeb does not accept responsibility for any damage or loss caused by accessing our services. We take all reasonable measures to ensure that our content is accurate, fair and free of malware but final responsibility rests with you. We take reasonable measures to ensure the availability of our services but have no responsibility or liability for interruptions caused by circumstances beyond our control


Limitation of liability

YOU ACKNOWLEDGE AND AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, IN NO EVENT WILL ITWEB OR ITS AFFILIATES, INCLUDING, WITHOUT LIMITATION, THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SUCCESSORS AND ASSIGNS, BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY DIRECT OR INDIRECT LOSS, DAMAGE, COST, EXPENSE OR LIABILITY OF ANY KIND ("LOSS") ARISING IN ANY WAY OUT OF OR IN CONNECTION WITH THE AVAILABILITY, USE, RELIANCE ON, OR INABILITY TO USE ITWEB SERVICES, INCLUDING (WITHOUT LIMITATION): (i) DAMAGES FOR BUSINESS INTERRUPTION, LOSS OF BUSINESS AND OTHER PROFITS, LOSS OF PROGRAMS, COST OF REPLACING EQUIPMENT OR SOFTWARE OR LOSS OF RECORDS, INFORMATION OR DATA, LOSS OF USE OF DATA, LOSS OF REVENUE, LOSS OF GOODWILL, LOSS OF CUSTOMERS, LOSS OF OR DAMAGE TO REPUTATION, LOSS OF CAPITAL, DOWNTIME COSTS, LOSS UNDER OR IN RELATION TO ANY OTHER CONTRACT, OR LOSS OF ANTICIPATED SAVINGS OR BENEFITS; (ii) ANY INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL LOSS; OR (iii) ANY LOSS ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN ITWEB CONTENT. THE EXCLUSION OF LIABILITY IN THIS SECTION APPLIES EVEN IF ITWEB SHALL HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS. WHERE RELEVANT, ITWEB’S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.
