The Huge Group is still waiting for MTN and iTalk to file merger papers with the Competition Commission.
However, the company is still opposed to the deal, and plans to fight it all the way.
However, the commission says that no merger notification has been filed yet.
MTN, SA`s second largest cellular operator, recently exercised its pre-emptive rights to purchase the 59% of iTalk it does not yet own, something it had previously declined to do. This effectively scuppered a deal for Huge, which had also made a bid valued at about R511 million.
iTalk Cellular is an exclusive MTN service provider, with 11 shops of its own, and a national network of 100 dealers.
James Herbst, Huge financial director, says the company believes "that the transaction between MTN and iTalk substantially lessens competition in South African mobile telecommunications".
To this end, he says: "We will await confirmation from the Competition Commission that MTN and iTalk have submitted their competition filing and once we have received this confirmation, we will proceed to enter our opinion on the matter."
In addition: "Once the recommendation has been made by the Competition Commission to the Competition Tribunal, we [Huge] will again file further submissions in support of our argument."
MTN said this morning: "The parties are in the process of compiling the appropriate papers and it is expected that submissions will be made in due course."
