Tribunal to hear Cell C

The Competition Tribunal has agreed to let Cell C participate in hearings on alleged anti-competitive behaviour by MTN.

Cell C yesterday appeared before the tribunal to appeal for representation rights at the MTN hearings.

The Competition Commission has found that MTN discriminated against Cell C in its community service telephone interconnection pricing.

However, Cell C told the tribunal its interest in the complaint referral could not be adequately represented by the commission.

Now that its participation in the hearings has been secured, Cell C will be able to attend and participate in all pre-hearing conferences and any interlocutory proceedings.

It can also request the tribunal to summon relevant people to appear at any hearing, cross-examine witnesses, and present evidence and make arguments in support of its application. Additionally, Cell C will have access to all documents related to the hearing.
