Apple seeks Samsung smartphone sale ban
Bloomberg Businessweek writes.
The action, targeting 10 smartphone models, was filed in the Dusseldorf Regional Court, and is based on Apple's design rights, court spokesman Peter Schuetz said. Apple also started a separate suit against five Samsung tablet computers related to a September ruling banning the Galaxy 10.1, he said.
Apple is also trying to block Samsung's attempts to get around product bans by retooling its devices, Mobiledia notes.
Last month, the Dusseldorf court said it would not grant an injunction against the Galaxy 10.1N, a tablet Samsung changed to get past bans on the 10.1, and an appeals court said it doubted an injunction against the original tablet covers the retooled model.
Meanwhile, Apple's newest lawsuits will allow the Cupertino, California-based company to seek damages against both models.
Report author Karin Matussek wrote: "The new suits aren't filed under emergency proceedings and allow Apple a new procedure against both models," Apple Insider reports.
A spokesperson for Samsung confirmed the South Korean electronics maker had received both lawsuits from Apple.
Apple made the first attack in the courtroom against Samsung in April, with a lawsuit accusing the company of copying the look and feel of the iPhone and iPad. That sparked a worldwide legal battle in which both companies have accused the other of patent infringement.
