AT&T issues ultimatum to Telkom

AT&T is to take Telkom to court if it does not supply certain services, saying the company is not abiding by a regulator decision in its favour.

AT&T this afternoon said Telkom has failed to comply with a June ruling by the Independent Communications Authority of SA (ICASA) in a two-year old set of complaints between the two parties.

"More than two weeks have passed since ICASA issued its ruling," AT&T said in a statement. "To date Telkom has failed to abide by the ruling and the direction made by ICASA instructing it to provide the telecommunication facilities AT&T requires."

It said two written requests for specific services had been sent to Telkom but both had been ignored.

If Telkom "continues to fail to abide" by the ICASA decision, AT&T plans to ask for a court order compelling it to deliver services. It points out that failing to comply with such an order could see company directors given prison sentences for contempt of court.

AT&T also says it is considering a request to the Attorney-General that Telkom be prosecuted under the Telecommunications Act.

Under South African telecommunications law AT&T must source certain infrastructure from Telkom.

Telkom representatives could not immediately be reached for comment. The company previously said it intended to take the ICASA decision under judicial review.
