DiData investor relations manager Bronwyn Goeller says the group is prepared to say only: "We don`t believe there is any merit in the claim and have accordingly instructed our attorneys to defend the matter."
Didata has until Tuesday to respond, and 21 days thereafter to prepare its court documents.
Comparex confirms that a claim has been lodged but is not prepared to comment further.
According to a report by online publication Moneyweb, the case centres on five former Comparex employees who were responsible for securing a contract with Coca-Cola Sabco and for Comparex`s relationship with former Naspers subsidiary Mindport.
Court papers say that shortly after leaving Comparex they were hired by a Dimension Data subsidiary. Comparex alleges that the five, whose contracts contained three-year restraint of trade agreements, divulged to DiData confidential information relating to Mindport and Coca-Cola Sabco.
Comparex is claiming damages on the basis of estimates of the profit it could have earned between June 2000 and December last year had the Mindport and Coca-Cola Sabco business not been lost.
Allan Cawood, CEO of Dimension Data South Africa, says this is a legal issue isolated to the PE region and as far as Dimension Data is concerned there is no animosity between the two companies.
