Shoden Systems, sole distributor for Hitachi Data Systems in SA, says Hitachi will comment by the end of this week on the patent infringement suit filed by EMC against Hitachi and Hitachi Data Systems.

Shoden Data Systems MD Fanie van Rensburg says Hitachi Data Systems corporate received the legal papers on Friday and is still reviewing the case.

On Friday, data storage system maker EMC accused Japanese electronics company Hitachi and Hitachi Data Systems of infringing on six patents. EMC said it had filed complaints with the International Trade Commission and the US District Court in Worcester, Massachusetts. It said this followed four years of attempts to amicably settle the dispute with Hitachi.

EMC is calling for Hitachi to be barred from importing its replication software or bundling it with its storage hardware.

EMC says the patents included in the complaints relate to its key data replication products, SRDF and TimeFinder, which allow corporations to protect vital data.

The local EMC office is not prepared to comment on the case at this stage.
