Telkom today informed the Independent Communication Authority of South Africa (Icasa) that it cannot accede to the regulator`s request not to implement its proposed tariff adjustments on 1 January 2002.
In a letter to Icasa this afternoon, Telkom indicated that it would implement its 2002 tariff adjustments as lawfully announced after the regulator had been notified of these on 14 November 2001.
In terms of its license conditions, Telkom is obliged to notify Icasa of its annual tariff adjustments, and announce these to customers at least 30 working days before implementation. This was duly done in mid-November, although Icasa indicated that a regulatory vacuum meant it was not in a position to review Telkom`s proposal.
On 26 November, new regulations were gazetted, and Icasa requested Telkom to refile its tariffs in accordance with these.
In its response today, Telkom reiterated that it was unable to refile its tariff adjustments in accordance with the new regulations, as these are invalid.
"The new regulations are defective, and Telkom is willing to engage with Icasa with a view to remedy these for future application," said Telkom`s Group Executive for Regulatory and Government Relations, Victor Moche.
