Telkom to proceed with least cost routing court action

Telkom published a notice in two Sunday newspapers inviting interested parties to join in the High Court action and raise a defence regarding the sale, distribution and use of least cost routing (LCR).

The case is set to proceed in the Pretoria High Court from 6 to 10 October, once users, providers and marketers of LCR have had the opportunity to make representations or join with Nedtel, Nashua, Orion and MTN in opposing Telkom`s application.

Telkom maintains that LCR involves the illegal circumvention of its . It is achieved through dedicated circuits, or through a terminal interface (DTI) device connected to a company PABX or private telecommunications network that dials or links directly into a mobile telecommunications network and circumvents Telkom`s network.

The High Court has recognised that the outcome of Telkom`s application could have consequences for users, marketers and suppliers of LCR, which is why it last month ordered Telkom to publish the notice that appeared over the weekend.

Telkom has disclosed in its prospectus that it had withdrawn its action against its 50% joint venture Vodacom. However, this does not preclude Vodacom from joining the other respondents in opposing Telkom`s application.
