3Com to intervene in Cisco, Huawei litigation

Johannesburg, 11 Jul 2003

3Com Corporation announced that the US Court for the Eastern District of Texas in Marshall, Texas granted 3Com`s motion to intervene in the litigation between Cisco Systems and Huawei Technologies.

"We are pleased that the court reviewed 3Com`s motion to intervene and, over Cisco`s objections, granted the motion," said Mark Michael, senior vice-president and general counsel, 3Com.

"The granting of this motion moves 3Com and its strategic partner Huawei forward in selling products that are acceptable from an intellectual property (IP) perspective and separate from the IP dispute between 3Com and Huawei."

It is in the best interest of 3Com, its customers and the competitive marketplace, to have the judge make clear that new products that 3Com will ship from the joint venture with Huawei are acceptable from an IP perspective.

This ruling ensures the current schedule for court proceedings will be maintained and allows 3Com to move forward in its partnership with Huawei, including the formation of a joint venture for enterprise networking products announced in March 2003.
