Disclosure of grey or parallel imports required

Phonatics (Pty) Ltd will repair and maintain all parallel imported products on offer (Plantronics and GN Netcom headsets) as per the original manufacturer's warranty, as it is not an authorised Plantronics/GN Netcom distributor.

Tracking the products that Phonatics sells is made possible by adding a unique bar code to each headset. By doing this, the repair centre is able to track the date of purchase and the relevant warranty periods of the units.

As from 9 February 2007, businesses selling grey or parallel imports will have to disclose this fact to consumers. This is in accordance with a regulation signed by the Minister of Trade and Industry after recommendations made by the Consumer Affairs Committee. The regulation is made in accordance with section 12(6) of the Consumer Affairs (Unfair Business Practices) Act No 71 of 1988.

In terms of the regulation, these South African businesses (or unauthorised distributors) must include in all forms of advertising or promotions or in-store promotions, Web sites and brochures or where the product is offered for sale the following words: "The authorised South African distributor of this product is under no obligation to honour the manufacturer's guarantees/warrantees or to provide after-sales service."

Grey or parallel imports are branded goods which enter the country and which are being sold by businesses which do not have the brand owner's permission to sell the products, so-called unauthorised distributors.

Typically this can happen where for example containers of LG flat screen televisions are exported from Korea for sale in Namibia through one of LG's authorised Namibian distributors. The Namibian distributor may then decide to sell some of his excess television sets to a South African business. These South African businesses may not be authorised by LG to sell its products and consequently any warranties given by LG may not be valid for the South African consumer. The sale of the products is not illegal; however, the South African businesses selling these LG televisions sets will have to make certain disclosures in terms of the newly released regulation.
