Mohlala serves papers on Nyanda

Mamodupi Mohlala, the dismissed Department of Communications (DOC) director general, has filed an urgent application with the Labour Court to be reinstated, or to seek interim relief until a settlement is reached.

Mohlala says notice was served on the State Attorneys at 11am yesterday to appear before the Gauteng Labour Court this Friday, 30 July, on behalf of communications minister Siphiwe Nyanda if they choose to oppose the application.

As part of her strategy, Mohlala on Monday wrote to President Jacob Zuma asking him to intercede in the dispute between her and Nyanda in order to reach an amicable settlement of the issue.

Mohlala was dismissed last week after Nyanda had announced that he had lost trust in her as director general, in effect the most senior public servant in the DOC.

“What I am seeking from the Labour Court is a finding this Friday saying that my dismissal was unlawful and I should be reinstated. If the court cannot make this finding, then I am asking it to declare an interim relief where I continue in my role as director general until a solution is found,” Mohlala says.

Tiyani Rikhotso, Nyanda's spokesperson, says as far as he knows the State Attorney has not notified the minister of any summons.

“The practice is that the State Law Advisor handles these matters and when they need anything from us, they let us know,” he says.
