Business Systems Group (Africa) (BSG) is a business and software solutions delivery company that has been operating in South Africa since early 1997. We own the registered trademark "BSG": the brand name which we are known by and operate under in the market.
In February 2006, we established that Simeka BSG was infringing on our registered trademark by including "BSG" as part of their registered company name. Simeka BSG conducts business in a similar industry sector to us, consulting and information technology, resulting in confusion in the marketplace.
We were obliged to approach the court to protect our company's trademark after Simeka BSG refused to act on numerous requests to cease using 'BSG' in its registered company name. On 20 February 2007, we obtained a court order, with immediate effect, to prevent Simeka BSG from using the trademark "BSG" as part of their company name.
Since this date, Simeka BSG has continued to use the BSG trademark, and we are now compelled to take further action to protect our rights. We feel this is necessary to prevent the continued devaluation, diffusion and further confusion of the "BSG" valued brand among our clients, suppliers and the general marketplace.
