SCO sues Novell for 'slander of title'

The SCO Group has sued Novell for "bad faith effort to interfere with SCO's rights with respect to Unix and UnixWare".

Mark Knight, SCO Group SA territory manager, confirms the branch has received a briefing in this regard, but will say no more than that. Novell SA MD Stafford Masie was not immediately available for comment.

According to SCO's Web site, Novell has made "false and misleading public claims" that it, not SCO, owns Unix and Unixware copyrights.

The suit is the latest in the ongoing saga between SCO and a growing group of other vendors and Linux users. It comes as Linuxworld Expo, reported to be Novell's first formal showcase of its Linux acquisitions, is about to kick off in New York City.

SCO is also involved in a lawsuit against IBM for "breach of contract" in making "SCO code available for use in Linux".

The low-down

In the latest legal action, SCO also charges that Novell made "false statements" in an attempt to discourage customers and users from doing business with SCO.

SCO is seeking preliminary and permanent injunctive relief as well as damages. The injunction would "require Novell to assign to SCO all copyrights that Novell has wrongfully registered, prevent Novell from representing any ownership interest in those copyrights, and require Novell to retract or withdraw all representations it has made regarding its purported ownership of those copyrights".
