The availability of several Telkom corporate contracts on its Web site is not a big issue, as the documents were a matter of public record, says Telkom.
Last night, ITWeb downloaded nine corporate contracts between Telkom and other ICT players from the fixed-line operator's Web site. Their appearance on the site was initially picked up by mailing lists which notified ITWeb, as well as other publications.
The contracts include interconnection agreements between Telkom and MTN, Vodacom and Cell C, as well as a licence and maintenance agreement between Telkom and SAP Africa.
Documents also included the shareholder agreement between Thintana Communications and Telkom, dated January 2003, as well as the registration rights agreement between the Department of Communications, Thinthana and Telkom.
Initial industry opinion was that the availability of the reports reflected a security breach, as the documents were assumed to be confidential and stored in a secure environment.
However, Telkom denies that there has been a breach on its Web site. The US Securities and Exchange Commission requires that Telkom, which is also listed on the New York Stock Exchange, make these documents available as a matter of public record, a spokesman says.
The documents have been available for quite some time, he says. The spokesman adds it takes no skill to access the documents.
People who visit Telkom's Web site and look up the investor relations section should be able to access the documents, he says.
