Telkom rejects IS`s claims

Cape Town, 03 Nov 2005

Telkom has rejected Solutions` (IS) accusations about congestion over the peering link and in turn accuses the Internet service provider of misusing it.

A statement issued today by Telkom, following another e-mail sent yesterday by IS explaining to customers why its service had experienced difficulties, says: "The peering link is continuously monitored and the results indicate that the peering link in question is in fact not congested."

Telkom says earlier in the year, the peering link was congested due to the fact that IS was sending non-peering traffic across the link in conflict with the agreement between the two.

"This caused Telkom to terminate the agreement. IS contested Telkom`s right to terminate the agreement in the High Court. The court upheld Telkom`s right to terminate and IS`s application was dismissed with costs," the statement says.

It adds that the two are still peering in terms of an interim arrangement, while they try to conclude a new agreement.

"The negotiations are at an advanced stage and it is expected that an agreement will be reached in the very near future," the statement says.

According to Telkom, it has imposed on IS to utilise the peering link only for the purpose for which it was intended, in order to alleviate the congestion on the link.

"Should IS experience a high volume of traffic it wishes to send to Telkom`s SAIX service, and which traffic is not peering traffic, then IS is welcome to approach Telkom to purchase the bandwidth it requires, at the normal commercial terms," the Telkom statement says.
