The Universal and Access Agency of SA (USAASA) is still without a CEO, despite aims to appoint one by the end of last month.

The position became officially vacant when former CEO James Theledi's appeal against his dismissal on charges of sexual harassment was rejected. He was axed by the agency in March.

But more legal manoeuvres by Theledi have again delayed the process, and now the agency does not expect to appoint someone to take his place until, at the earliest, the end of this month.

No relief

The agency's lawyer, Nick Robb - a partner at Webber Wentzel - says Theledi filed an urgent interdict at the Johannesburg Labour Court, which was launched on 18 September.

USAASA filed its responding affidavit on 23 September and the matter was heard last Friday. Robb says Theledi was not successful, and his application was dismissed with costs.

Commission for Conciliation, Mediation and Arbitration (CCMA), where it currently is. “Theledi wanted to keep the position open until there was a decision on his case.”

Robb says Theledi's claim of unfair dismissal is due to start being heard at the CCMA, in Pretoria, on Monday.

Theledi was not available for comment this morning.

He was suspended by the agency after being found guilty, during an internal disciplinary process, of sexual harassment. This related to an incident that occurred at the Presidential International Advisory Council on Information Society and Development meeting, held last September.

Winile Lamani, the agency's operational head, has been acting as CEO for the past six months. The new CEO can expect a salary package of about R900 000 a year.
