A new look at cyberlaw

Legal firm Buys Inc today launched the second edition of its legal reference book Cyberlaw@SA II, an update of the original that was published in 2000 when cyberlaw was in its infancy.

South African cyberlaw has since blossomed, with government having passed several new laws such as the Electronic Communications and Transactions Act and the of Interception of Communications Act.

The rapid growth of Internet usage means these laws will have to be revisited and some newer ones brought in. This includes a possible Convergence Act and a Privacy Act designed to bring the country in line with international best practice.

As with the original, Cyberlaw@SA II is edited and has chapters written by Buys Inc founder and chief executive Reinhardt Buys, and has contributions from more than 20 other legal experts.

Topics covered include online copyright, trademarks, domain names, patents, the Electronic Communications and Transactions Act, encryption, authentication, digital signatures, consumer protection, pornography, hate speech, defamation, telecommunications law, taxation, criminal law and online dispute resolution.

Issues such as Internet service provider liability and freedom of speech are also covered.

There is also a Web site, www.cyberlawsa.co.za, edited by Francis Cronje, who contributed to the chapter on cryptography and electronic authentication.

Other authors include Lisa Thornton of Thornton and Morris Attorneys, Amos Khumalo of Khumalo`s Attorneys and Wendy Rachmim of Cheadle, Thompson and Haysom Inc Attorneys.

Included in the book is an IT risk checklist compiled by Reinhardt Buys and advocate William Heath that is aimed at company directors and compliance officers.
