High Court backs IBM

IBM`s South African division has won a court case brought against it by Business Connexion (BCX).

BCX, the subject of a takeover bid by Telkom, recently filed a case against IBM SA in the Johannesburg High Court, which sought to force IBM to dismiss a former BCX employee who had a restraint of trade contract with BCX.

On Thursday, Judge Snyders ruled in favour of IBM SA, which had opposed the application. The case was dismissed with costs.

It is understood this is not the first time BCX has challenged a company in the High Court over a restraint of trade agreement.

At the time of publication, no one at BCX could be reached who was in a position to comment on the case, and why it was brought against IBM and not the former employee.

IBM could also not provide any further details on the matter. BCX has 60 days in which to respond to the ruling.
