IT outsourcing company TSS and the Department of Justice this morning received word in the Pretoria High Court that GijimaAst`s lawsuit against the organisations have been dismissed with costs.
Graeme Allcock, TSS Managed Services GM of sales and marketing, says the judgement handed down mid-morning vindicates the company. "It`s a large weight off our shoulders and TSS`s name has been vindicated finally."
GijimaAst FD Carlos Ferreira says while he was not present at the judgement, he found it strange that an urgent interdict had taken over a year to be heard.
The company filed the interdict in August last year, requesting that the court review the justice department`s awarding of a tender relating to the e-Justice roll-out programme to TSS. Ferreira says the company felt the proper procedures in terms of the Public Finance Management Act were not followed.
Ferreira will study the documents and take legal advice before deciding on a way forward, but the company may have to review its position, he says.
A Department of Justice release issued last August states the awarding of the tender was delayed for a month to allow then director-general advocate Menzi Simelane to investigate allegations of irregularities.
